Poor Tengku Temenggong of Kelantan Tengku Muhammad Fakhry Petra Sultan Ismail Petra. He won 3 legal suits (all uncontested) in Malaysia against his teenage Indonesia wife, Cik Puan Temenggong Manohara Odelia Pinot and her mother Daisy Fajarina. But Tengku Muhammad Fakhry Petra Sultan Ismail Petra has found out that winning the suits is the easy part; enforcing them is the difficult part. Now a frustrated Tengku Muhammad Fakhry Petra Sultan is threatening to take legal action in Indonesia. He is thinking of suing Manohara Odelia Pinot and Daisy Fajarina there.
To summarize, on November 5, 2009 Tengku Muhammad Fakhry Petra Sultan Ismail Petra won his RM 105 million defamation suit against Manahora Odelia Pinot and Daisy Fajarina in a default judgement (because both the defendants were absent and were not represented by legal counsels).
Then on December 13, 2009 Tengku Muhammad Fakhry Petra Sultan Ismail Petra won an uncontested suit at the Syariah High Court when the judge ordered Manahora Odelia Pinot to return to her husband (“be loyal”). At the same time, the judge also ruled that the RM 1,112,250 she received from her husband was not a gift as she contended, but it was in reality a loan. Manahora Odelia Pinot was therefore ordered to repay that loan.
Since then, both Manahora Odelia Pinot and Daisy Fajarina had ignored these Malaysian judgements, arguing that as Indonesian citizens they are not bound by them. They did not respond to the judgments from both the Syariah High Court and the civil court.
Now lawyers acting for Tengku Muhammad Fakhry Petra Sultan Ismail Petra have enlisted the help of both the Indonesian and the US Embassy to try and enforce the court judgments. The lawyers hope that the Indonesia Embassy will advise Manohara Odelia Pinot and Daisy Fajarina to obey the Malaysian court judgments, but they acknowledge that foreign laws do not apply in Indonesia. Lawyer Mohd Haaziq said: “We have sought the help of the Indonesian embassy to send the judgments to Manohara for her to abide by them.”
Lawyers Mohd Haaziq, Zainul Rijal Abu Bakar and Abdul Halim Bahari met with representatives of the Indonesian Embassy in Malaysia for this purpose recently. Mohd Haaziq said: “The embassy would use its own channels to serve the papers, and a government agency’s word would carry more weight.”
The lawyers were met by Indonesian Minister Counsellor for Information, Social and Culture to Malaysia Widyarka Ryananta and the documents were received by Minister Counsellor for Consular Affairs Amiruddin Pandjaitan.
In a separate move, the lawyers also contacted the US Embassy for help. Manohara Odelia Pinot is said to hold US citizenship also as her father is an American citizen.
32-year old Tengku Muhammad Fakhry Petra Sultan Ismail Petra married 18-year Manohara Odelia Pinot on August 26, 2008. 9 months later, she made a dramatic escape when visiting her sick father-in-law in Singapore, alleging mental and emotional suffering resulting from physical and sexual abuse by her husband. Tengku Muhammad Fakhry Petra Sultan Ismail Petra had denied such allegations.
Think about it. Can this marriage be saved? If not why did it fail? Does the age gap between Tengku Muhammad Fakhry Petra Sultan Ismail Petra and Manohara Odelia Pinot has anything to do with this? And has Daisy Fajarina got a hand in this marriage breakdown? And why didn’t Manohara Odelia Pinot and Daisy Fajarina defend themselves in Malaysia courts? Isn’t marriage suppose to last a lifetime?
