Ariel, Luna Maya And Cut Tari May Be Charged Under Anti-Pornography Law
Police have now reached tentative conclusion that the trio engaging in sexual acts on 3 Youtube videos are the real Nazril Irham aka Ariel, Luna Maya and Cut Tari. They have dismissed claims from Ariel, Luna Maya and Cut Tari that the people in these sex videos were look-alike imposters out to create mischief. Police have said that Ariel, Luna Maya and Cut Tari may be charged under the country’s anti-pornography law while Cut Tari could potentially be charged for adultery since she is married. Ariel is the vocalist from the pop band Peterpan, now renamed in cyberspace as Peterporn while Luna Maya and Cut Tari are well known celebrity models, actresses and TV presenters.
Police Believes That Ariel Shot The Sex Video Clips
Last week, Comr Gen. Ito Sumardi, the National Police chief of detectives said that there were no look-alikes, and it was really Ariel, Luna Maya and Cut Tari who appeared in the porn videos. The trio have now gained international notoriety, with international media coverage. CBS TV called the sex videos Indoneisa’s first celebrity sex tape scandal. A police spokesman said: “We are still summoning several experts to prove our allegation that Ariel intentionally produced these videos.”
Possibile Violation Of Laws
If Ariel, Luna Maya and Cut Tari did indeed participate in the sex videos, what laws could they be charged with? A police source said: “After a short interview with Ariel and Luna Maya on Friday, we are starting to focus our investigation based on Law No. 44/2008 on Pornography. We believe that they breached the law, even though so far there are no indications that they intentionally distributed these videos.”
More specifically Ariel, Luna Maya and Cut Tari could be charged with violating Article 4 of the anti-pornography law. This specifically prohibits producing, creating, reproducing, copying, distributing, broadcasting, importing, exporting, offering, trading, renting or otherwise making availble pornography in Indonesia, whether for public or private consumption. The penalty for violating this law is a jail term of up to 12 years and fines of up to Rp 6 billion ($654,000).
And just by appearing in the videos, Ariel, Luna Maya and Cut Tari are said to have violated the law on modelling for pornography. A police source said: “We are on the way to proving that both of them, Ariel also, violated Article 8, which states that a person is prohibited from knowingly or consentingly being objects or models for pornographic content.” Those caught violating this law face fines of up to Rp 5 billion and up to 10 years in prison.
Cut Tari May Face Additional Charge
Legal expert Rudi Satrio from the University of Indonesia said that Cut Tari, who is married, could be charged with Criminal Code violation of adultery. But Rudi Satrio added this qualification: “But first, there must be an official complaint from her husband and it should be ascertained when this sexual activity happened. Did it happen before her marriage? If yes, it cannot be prosecuted.”
But How Did The Videos Get To Be Circulated In Cyberspace?
If Ariel did indeed shoot those pornographic videos, then the question is how did these sex videos get uploaded into cyberspace? Speculation is that Ariel lost his harddisk containing these videos, and the person who found it couldn’t resist uploading it. But police are now hot on the trails of the people who did the initial uploading. It seems that the IP addresses of the initial uploaders have been found. Perhaps somewhat complacement, the initial uploaders did not think of using an internet cafe to do the uploading.
Reaction From The Islamic Defenders Front (FPI)
Meanwhile the hardline Islamic Defenders Front (FDI) have described the sex videos as “terrorism”, having a negative impact on the morality of Indonesians. Habib Salim, head of FDI told a rally: “Porn actors and actresses are another form of terrorism. This is moral terrorism. We have to save the citizens from any harm that will degrade our morality.,”
Then Habib Salim issued this threat: “If the police cannot arrest Ariel, Luna Maya, and Cut Tari within three days, we are going to raid places that sell porn videos in Jakarta . We are still waiting for the police’s investigation, but if they fail, we were going to take action.”
So what does Habib Salim want to see happen next concerning Ariel, Luna Maya and Cut Tari? Habib Salim said: “They should stop their activities as entertainers as they are bad examples and have a bad influence on people. I urge Muslims to stop admiring them.”
Police Raided Schools
There are press reports that police are raiding schools to do spot checks on the cell phones of students to see if they have downloaded the sex videos featuring Ariel, Luna Maya and Cut Tari. So far this does not appear to be a problem.
Think About It
Indonesia does not need this kind of international attention. Certainly not after the Bali Kuta Beach Cowboys and the Bali porn video on Koreana. Now with these sex videos by Ariel, Luna Maya and Cut Tari, it seems that foreigners may be forgiven to think that Indonesia is all about easy or free sex. Does Indonesia, a Muslim majority country, deserves this reputation? What could possibly have prompted whoever the initial uploaders were to upload the porn videos to YouTube. Once uploaded, it spread very quickly, and on Twitter Peterpan quickly became Peterporn. But what prompted Ariel to video tape his own sexual conquests in the first place, if indeed he is the one who filmed these acts? And why did Luna Maya and Cut Tari, if they are the guilty parties, agree to be filmed in the sex acts? Did they not know that the sex action was being filmed?
