While the news of late has been about the Syariah High Court’s order to runaway Indonesia teenage model Manohara Odelia Pinot to obey her Kelantan prince husband Tengku Muhammad Fakhry Sultan Ismail Petra by returning to him, let’s not forget that early last month the husband had won a demation suit against both Manohara Odelia Pinot and her mother, DaisyFajarina.
Judgment in default was given to Tengku Muhammad Fakhry Sultan Ismail Petra when Manohara Odelia Pinot and Daisy Fajarina failed to turned up in court to defend their case, either in person or by legal counsels. Mohd Haaziq Pillay, counsel for Tengku Muhammad Fakhry Sultan Ismail Petra said: “The defendants have been given the opportunity to appear in court with evidence to support their allegations, but until today, they have not turned up”.
Explaining why Tengku Muhammad Fakhry Sultan Ismail Petra is suing Manohara Odelia Pinot and Daisy Fajarina for a massive Rm 105 million (approximately US$30.8 million), Mohd Haaziq Pillay said: “Money is not the issue for my client. This is about his dignity and reputation.” Emphasising this point further, Mohd Haaziq Pillay said that the court would assess the actual amount of damages to be awarded to Tengku Muhammad Fakhry Sultan Ismail Petra “based on the plaintiff’s status.”
In his statement of claim, Tengku Muhammad Fakhry Sultan Ismail Petra said that words used by Manohara Odelia Pinot and/or Daisy Fajarina to describe him were circulated widely in print and in cyberspace, both in Malaysia and Indonesia. He considered these words as defamatory, as they imply he was guilty of mistreating, sexually harassing, abducting and unlawfully confining Manohara Odelia Pinot. He contended that these allegations were untrue, and were uttered to disparage him in the eyes of members of the royalty, the Government and the public.
Tengku Muhammad Fakgry Sultan Ismail Petra has also applied to the High Court for an injuction to restrain Manohara Odelia Pinot and Daisy Fajarina from further defaming him by repeating these same defamatory words against him.
