Ariel Arrested Under Anti-Pornography Law Over Peterporn Sex Videos

In a major development on the Peterporn sex video scandal, National Police arrested Nazril Irham aka Ariel for violation of the Anti-Pornography Law.  Luna Maya and Cut Tari retain their status as witnesses and have not been charged.  Meanwhile Communications and Information Technology Minister Tifatul Sembiring, who came under heavy criticism for his remarks linking the Peterporn sex videos to the crucifixion of Jesus Christ, has finally apologized. Or did he?

How Ariel Was Arrested

National Police has now changed the status of Ariel from witness to suspect and has arrested Ariel under the country’s Anti-Pornography Law over the 3 sex videos believed to involve Ariel, Luna Maya and Cut Tari.  However, at least for the moment, the status of Luna Maya and Cut Tari remain as that of a witness.

Disclosing the arrest of Ariel, National Police chief of detectives Comr. Gen. Ito Sumardi said: “He did not turn himself in but he was turned in by his lawyers on Tuesday morning. He is under arrest.” It is not known Ariel has been charged under which section of the Anti-Pornography Law.  However the Anti-Pornography Law states that  anyone who produces, makes, disseminates, broadcasts, imports, exports, offers, sells, rents or provides pornography can face a minimum six month or maximum 12 year jail term and they can also be fined from Rp 250 million ($27,700) to Rp 6 billion.

Andika Summoned

Police meanwhile has summoned Andika, former keyboardist at Ariel’s pop band, Peterpan (now renamed in cyberspace as Peterporn) for questioning.  Andika, who is a friend of Ariel, is listed as a witness.  Asked to comment on the Peterporn sex videos, Andika said: “I don’t know, I haven’t seen it yet.  As a good citizen, I am answering the police invitation.”

Police are still investigating how the sex videos featuring Ariel, Luna Maya and Cut Tari came to be uploaded into cyberspace.

Tifatul Sembiring Taken To Task For Comparing Sex Videos To Cruicifixion

Communications and Information Technology Minister Tifatul Sembiring has come under heavy flaks for his recent remarks comparing the sex videos with the cruicifixion.  Minister Tifatul Sembiring said that the ambiguity over the identities of the porn stars in the Peterporn sex videos. if unresolved, could lead to a situation similar to the ideological dispute between Muslims and Christians over whether it was the real Jesus Christ or a lookalike who was crucified on the cross. Ariel, Luna Maya and Cut Tari all denied being the characters in the Peterporn sex videos, claiming to be victims of lookalike imposters. 

Todung Mulya Lubis, well known lawyer and rights activist, speaking at a conference organized by the Wahid Institute said: “Every state official has to have dignity, conscience and morality. If Tifatul doesn’t, the President needs to take firm action against him, not only by reprimanding him but by removing him from his post.”

Todung Mulya Lubis went on to say: “A minister must never make a statement that degrades a religion, he needs to apologize. The sex tapes controversy is a private matter. Even though there may be a legal matter in it, it is none of Tifatul’s business.”

Syafii Maarif, former chairman of Muhammadiyah said that Tifatul Sembiring’s statement “went too far” and “it’s only making matters worse.”

Yenny Zannuba Wahid, executive director of Wahid Institute said: “The comment was tendentious and unwise. It can mislead the public. Such a statement can be used on the grass-roots level and quoted repeatedly. Thus, it has the potential to create tension and even spark clashes between religions in the country.”

Yenny Zannuba Wahid then read a statement from various religious leaders saying “this shows the minister’s insensitivity to the public sense of religiousness.” Yenny Zannuba Wahid then asked Christians not to be provoked but to keep fostering interreligious harmony.

Religious leaders have also responded.  Father Benny Susetyo from the Indonesian Bishops Conference called Minister Tifatul Sembiring’s statement “deluding and inappropriate”, reflecting a “lack of statesmanship.” The Rev Gomar Gultom from the Indonesian Communion of Churches, noting that the crucifixion was the “essence of Christianity” asked: “How come a minister could make such an analogy?”

Tifatul Sembiring’s Apologize – But For What?

After receiving heavy criticism on his Twitter account, Minister Tifatul Sembiring finally issued what he described as an apology.  On his Facebook page he “apologize for the inconvenience”.  That, of course, is different from apologising for his remarks.  Indeed Minister Tifatul Sembiring posted a clarification on his Facebook page, defending his earlier remarks.  Minister Tifatul Sembiring said: “My remarks are historical facts and it was neutral.”

Yenny Zannuba Wahid said: “He should show that he is sincere in his apology with a real act of statesmanship, especially since he was chosen as a minister to represent a Islam-based political party,”

Todung Mulya Lubis said: “A public official should have the humility to apologize for a mistake.”

Both Yenny Zannuba Wahid and Todung Mulya Lubis said that Minister Tifatul Sembiring should make a public apology, because his original remarks were made at  publicly, and also because  Facebook and Twitter were not accessible to everybody.

Think About It

When is an apology really an apology?  Is apologizing for causing “the inconvenience” the same as apologizing for making the analogy between the sex videos and crucifixion?  Is it so difficult to say sorry publicly rather than saying it via Facebook and Twitter?  How should President Susilo Bambang Yudhoyono react to Minister Tifatul Sembiring’s conduct?  And coming back to Ariel’s arrest, what implications will this have on Luna Maya and Cut Tari?  Will it be a matter of time when they too will be arrested?  Or will they turn state witness?
